Effects of the 8th Amendment on American Law Essay The Eighth Amendment Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.Ever since the Eighth Amendment was ratified by the states in 1791, it has been a key part of our Constitution. The Eighth Amendment has protected our people from many things, including an overly high bail or unnatural punishments. It has ensured that in civil matters, as well as criminal cases, the people of America are protected from an overly high bail and cruel and unusual punishments. The Eighth Amendment has stirred up many controversies with its many paths of interpretation, in that the U.S. amendments are written down on paper but sometimes not properly enforced. The 8th amendment is the one I favor least and is to be examined during this assignment. I take the double-minded position on the subject of the 8th Amendment of for and against this amendment. Is the Death Penalty an Effective Punishment? In my opinion yes, with at least one important respect, it simply cannot be argued that a killer, once executed, can ever kill again. The crime must fit the punishment in order to justify, and this punishment must not favor anyone on the foundation of color. If this were the case I would without a doubt totally agree with this amendment, however, Studies show that there are racial biases when the death penalty is carried out. Since the resumption of executions in the early 1980s, 40 percent of those executed have been black. And more often than not blacks were more often executed than were whites without having their conviction reviewed by any higher court. The race of the victim and the defendant inevitably influences the decision to seek a death sentence. University of Iowa law professor David Baldus conducted an exhaustive criminal sentencing study in Georgia in the 1980s. He found that prosecutors sought the death penalty for 70% of black defendants with white victims, but only 15% of black defendants with black victims. Similar patterns of racial bias are found across the country. Over half of those on death row are people of color. Black men alone make up over 42% of all death row prisoners, though they account for only 6% of people living in the U.S. Nationwide, cases involving a white victim and a defendant of color are most likely to result in a death sentence. The Baldus study found that six out of ten defendants sentenced to death in Georgia for  killing a white person would not have received a death sentence had their victim been black. A case involving a white person was over four times more likely to result in a death sentence than was a comparable black victim case. In Maryland the state with one of the highest percentages of African Americans on death row a death sentence is eight times more likely in a white victim case than a black victim case, according to a 1987 Public Defenders Office study. Nearly half of those executed since 1976 have been people of color, with blacks alone accounting for 35%. All told, 82% have been put to death for the murder of a white person. Only 1.8% was whites who had been convicted of killing people of African, Asian, or Latin descent. Meanwhile, people of color are the victims in more than half of all homicides. Since 1930, one in two persons executed was black. Monday Theology First off, let me start by saying that Siddhartha is a book that I never would have voluntarily chosen to read. A book based on Indian culture (dot, not feather) and set in a period of many years ago didn’t sound like my idea of a fun evening’s read. But now, after completing it, I can say that I was 100 percent incorrect and pleasantly surprised. This book was just chocked full of all kinds of symbols, signs and ideas, two of which really seemed familiar to me. Not because they are novel or revolutionary, but more because they are beliefs that I have held for sometime now. And the interesting thing is that I am not exactly sure where they came from. The first and probably most dominant theme was that of where Siddhartha was trying to find his enlightenment. He began by following a strict regime and belief structure that he was born into. He then â€Å"rebelled† and started to follow the Samana’s and their practice of self denial. Later, he went 180 degrees and indulged in â€Å"the sins of the flesh†. Not finding contentment in either of these, he finally settles on living on the river and becoming a ferryman. This is where he found the true meaning of Nirvana. He realized that true enlightenment cannot be reached through teachers because it cannot be taught- enlightenment comes from within. This is where I step into the picture. At the start of this semester, we were asked to tell something about ourselves, and where we were spiritually. I stated that I was a â€Å"Ten Commandment Kid†, being raised on bible movies on Sunday morning TV. I also stated that I had no formal biblical training, and that I went with my grandfather on â€Å"Sunday morning road trips† to his newest church of the month. Or week. I think that he was like Siddhartha in the fact that he was never satisfied with the answer that anyone ever gave him, so he moved on, still searching. This was his gift that he gave to me. The places that I attended and the movies that I watched asked many more questions than they ever answered. Even as young as eight I realized that while knowledge was good, true enlightenment, or wisdom, wasn’t going to come from any one pulpit or preacher. I have since found that the best church is on top of a hill, looking over a pasture with a gentle breeze blo wing the clouds slowly by.

Face Negotiation Theory Essay

The Face Negotiation Theory is established by Stella Ting-Toomey, which discusses the way by which people with different cultures communicate and manage conflict. In 1985, Stella Ting Toomey explains in her theory that disagreements and conflicts are usually brought about by identity management on the individualistic and collectivistic levels. The different facets that characterizes the identity of an individual or group is referred to as â€Å"faces†. Faces serves as the public image of an individual or group, which the society as a whole assessed depending upon the cultural norms and values of the people’s respective culture. According to Ting-Toomey, the distinction between individualistic and collectivists cultures is seen on how the former gives more importance to the face of the individual while the latter gives more attention to the welfare of the group (Gudykunst, 2005). The major tenets of the Face Negotiation Theory are greatly applicable with my life, especially since I interact with people that have different cultural background. I have friends who do not share the same culture that I have and sometimes this is the cause of misunderstandings between us because cultural differences also affect the values and principles that we have in life. However, I realized that in order to get along with my friends I need to understand and accept our differences and in doing so, I need to properly communicate with them in a way that shows my respect to their values and beliefs, which is actually one of the important things that is explained in the theory. In relation to this, I also learn that the theory can actually help me to enhance my communication process in the future wherein I could try having a more collectivistic face, which will allow me to give more importance to the welfare of the group rather than my individual interests. Moreover, I realized that the relevance of the Face Negotiation Theory has become more vital than ever because our society is becoming more interconnected with each other, especially with the greater interaction of different people all over the world. Creating a new character for a soap Essay

The TV programme I chose to use as my soap is the American show ‘The O.C’ after watching numerous episodes of it in class and at home. I chose this programme because it was one that I was most familiar with, and a programme that I enjoyed watching. ‘The O.C’ is an American show, aimed at a teenage audience, as it follows the lives of teenagers and their families in Orange County, California. It mainly concentrates on the story of Ryan Atwood, a teenager from a rough town and a run down family who throw him out after a run in with the police. Sandy and Kirsten Cohen, who are part of a wealthy family, adopt him, and they invite him to live in their pool house at their home. They already have a son, Seth Cohen, who is your typical nerdy character, whom Ryan becomes brothers with. They both have to deal with life in Orange County, a place that comes across for the rich and good looking. They also have to deal with their relationships with Marissa Cooper, the girl next door when Ryan moves in, and Summer Roberts, Seth’s dream girl. Summer is portrayed as a stereotypical spoiled rich girl, with some snobiness. This is displayed in the first episode, where Summer is at first attracted to newcomer Ryan Atwood, until she finds out he is from Chino, prompting the response â€Å"Chino, eww.† However, different sides to Summer become evident as she develops. It is during her transformation that Summer falls in love with Seth, the boy who was never popular. Marissa also comes from a rich family, as the girl next door. But has a troubled time as her family falls apart. Ryan is the person who has to help her through this. The character that I have decided to create is called Claire Atwood. Claire is the sister of Ryan, but neither of them know they are related when the character is first introduced, and neither do the audience at first. She is fairly tall and slim, with blonde hair, and good-looking features like most of the other female characters in the show. Her good looks are what make her fit in with the show, as she full-fills the male gaze like many of the other female characters. The first scene that introduces the character, is the first day back at school for Ryan, Seth, Summer and Marissa. Seth and Ryan notice her walking down the hallway of the school, and can’t help but stare, as they are instantly attracted to her. They end up being in the same class, and she has to sit right in the middle of both Ryan and Seth. Nobody talks to her in the scene, and we don’t hear her speak either. The camera shows us a shot of her writing her name on a sheet of paper as she finishes her work, and she writes the name ‘Claire Atwood’. Only the audience sees this, and we instantly know that she is related to Ryan, as we know he has the same surname. I think the character would bring a lot to the show, including a sense of humour and irony. Marissa, who becomes Ryan’s girlfriend, becomes jealous of Ryan’s involvement with the new character as he offers to help her to do a school project. But only the audience knows that she is his sister, creating the irony and humour of the situation. The way in which she fits in, is because of her good looks. But Ryan and Seth become more and more suspicious of her, as she never lets anyone come to her house. They both follow her home one-day and discover that she is living in a trailer park. So we see that she doesn’t completely fit in, as she isn’t from a rich family, living in a big house like most of the other characters in Orange County. Ryan goes and knocks on the door of the trailer, and the door is opened by his biological dad, who has just come out of prison. This is when it is discovered that Claire is the sister of Ryan. Later in the programme, we discover that the father had been treating Claire poorly, and she comes to live with The Cohen family too. The character creates a lot of conflict in the show, something that greatly appeals to a lot of audiences. Ryan is very protective of her, and gets into fights with other boys who seem to take an interest in his sister, until Claire tells Ryan to stop being so protective. She is also a character that will attract more females to the show. We have followed the story of Ryan coming from the wrong side of the tracks and getting a chance to live in Orange County, being something that the male viewers can enjoy to watch as they are relating to another male character. But now we can follow the life of Claire, as she also comes from the wrong side of the tracks, in a very similar situation to Ryan’s. She has an aggressive personality, due to her poor upbringing as a child, and at first does not get along with the Cohen family, as she tells them she doesn’t want their help. She also gets into fights with other girls at the school, as she against most people who have wealth and tells everyone that she doesn’t need it. As her relationship as a sister to Ryan becomes stronger, and she becomes best friends with Marissa and Summer, they eventually convince her to move in with the Cohen family. Jamie Parker The first scene The fist scene involving Claire Atwood very much full-fills the male gaze. We see Ryan and Seth talking near their lockers, and they are instantly struck by Claire walking down the hallway. The camera cuts to her feet walking along, and slowly pans upwards to her face, then a long shot of her walking down the corridor towards the camera. The scene is played in slow motion, not only for the male gaze, but also to emphasize the importance of the scene, and the importance of the new character that is being introduced to the program. Because of the scene, we know she is going to have some importance, and not just a one off showing of a insignificant character. Whilst this is being shown, there is fast paced music playing, But as Claire, Ryan and Seth sit down in the classroom, the music slows and becomes more mysterious. The audience knows because of this, that there is something significant and important to this character. The camera zooms into Claire’s hand as she writes her name on the paper. And it is revealed to the audience that she is related to Ryan.

Introduction to New England Colonial Architecture When the British landed on the shores of the New World, they not only brought place names from England (e.g., Portsmouth, Salisbury, Manchester), but the colonists also carried the knowledge of building traditions and architectural styles. The religious separatists we call Pilgrims arrived in 1620, quickly followed by a group of Puritans in 1630, who settled in what became the Massachusetts Bay Colony. Using whatever materials they could find, the immigrants constructed timber-framed houses with steep roofs. Other settlers from Great Britain spread throughout Massachusetts, Connecticut, New Hampshire, and Rhode Island, building rustic dwellings like the ones they had known in their homeland. They colonized land that became New England. The earliest dwellings were likely hastily-constructed sheds and cabins - the recreation of the Plymouth Colony shows us this. Then, shoring up against the cold New England winters, colonists built single-story Cape Cod houses with massive chimneys placed at the center. As families grew, some colonists built larger two-story homes, still to be seen in communities like  Strawbery Banke on the New Hampshire coast. Colonists expanded their living space and protected their property with sloping saltbox roof additions, named after the shape of boxes used to store salt. The Daggett Farmhouse, built in Connecticut around 1750, is a good example of the saltbox roof style. Wood was plentiful in the northeastern forests of the New World. The English people who colonized New England grew up with architecture from late medieval and Elizabethan England. The British colonists were not far removed from the reign of Queen Elizabeth I and medieval timber-framed houses, and they continued these building practices through the 1600s and well into the 1700s. The 1683 Parson Capen House in Topsfield, Massachusetts is a good example of Elizabethan architecture in New England. Since these simple homes were made of wood, many burned down. Only a few have survived intact, and fewer still have not been remodeled and expanded. New England Colonial Types Styles Architecture in Colonial New England went through many phases and can be known by various names. The style is sometimes called post-medieval, late medieval, or first period English. A New England Colonial home with a sloping, shed-like roof is often called a Saltbox Colonial. The term Garrison Colonial describes a New England Colonial home with a second story that juts out over the lower level. The historic 1720 Stanley-Whitman House in Farmington, Connecticut is described as a post-medieval style, because of its second-story overhang, but a later lean-to addition transformed the  Garrison Colonial into one with a saltbox-style roof. It did not take long for colonial styles of architecture to combine to form new designs. Modern Colonials Builders often imitate historic styles. You may have heard words like New England Colonial, Garrison Colonial, or Saltbox Colonial used to describe modern-day homes. Technically, a house built after the American Revolution - after communities were no longer colonies of England - is not colonial. More correctly, these homes of the 19th and 20th centuries are Colonial Revival or Neocolonial. Northern versus Southern Colonial Houses Early New England colonial houses were usually located mostly along the shores of Massachusetts, Connecticut, New Hampshire, and Rhode Island. Remember that Vermont and Maine were not part of the 13 original colonies, although much of the architecture is similar, modified by French influences from the north. Northern colonial homes were wood framed construction, usually the plentiful white pine, with clapboard or shingle siding. Early homes were one story, but as more family arrived from Britain these starter homes became two-stories, often with steep roofs, narrow eaves, and side gables. A large, center fireplace and chimney would heat upstairs and downstairs. Some homes added the luxury of saltbox-shaped lean-to additions, used to keep wood and supplies dry. New England architecture was inspired by the beliefs of the inhabitants, and the Puritans tolerated little exterior ornamentation. The most decorative were the post-medieval styles, where the second story slightly protruded ove r the lower floor and the small casement windows would have diamond-shaped panes. This was the extent of decorative design. Beginning with the Jamestown Colony in 1607, New England, Middle, and Southern Colonies were established up and down the eastern coastline of what would become the United States. Settlers in southern regions such as Pennsylvania, Georgia, Maryland, the Carolinas, and Virginia also constructed uncomplicated, rectangular homes. However, a Southern Colonial home is often made with brick. Clay was plentiful in many southern regions, which made brick a natural building material for southern colonial homes. Also, homes in the southern colonies often had two chimneys - one on each side - instead of a single massive chimney in the center. Tour New England Colonial Homesteads The New England Colonial home of Rebecca Nurse was built in the 17th century, making this giant red house a true Colonial. Rebecca, her husband, and her children moved here to  Danvers, Massachusetts around 1678. With two rooms on the first floor and two rooms on the second, a large chimney runs through the center of the main house. A kitchen lean-to addition with its own chimney was built in about 1720. Another addition was constructed in 1850. The Rebecca Nurse house has its original floors, walls, and beams. However, like most homes from this period, the house has been extensively restored. The lead restoration architect was Joseph Everett Chandler, who also oversaw the historic restorations at the Paul Revere House in Boston and the House of Seven Gables in Salem. Rebecca West is an interesting figure in American history for being a victim of the Salem Witch Trials- in 1692 she was accused, tried, and executed for practicing witchcraft. Like many historic homes throughout New England, the Rebecca Nurse Homestead is open to the public for tours. Many of New Englands finest colonial homes are open to the public. The Hoxie House in Sandwich, Massachusetts was built in 1675 and is said to be the oldest house still standing on Cape Cod. The Jethro Coffin House, built in 1686, is the oldest house on Nantucket.  The home of author Louisa May Alcott, Orchard House in Concord, Massachusetts, is a good example of farmhouses built between 1690 and 1720. The town of Salem, Massachusetts is a museum itself, with the House of Seven Gables (1668) and the Jonathan Corwin House (1642), also known as the Witch House, being two popular tourist attractions.  A Boston home built in 1680 and once owned by American patriot Paul Revere is a popular post-medieval style to view. Lastly, Plimoth Plantation is the Disney-equivalent of 17th century New England living, as the visitor can experience an entire village of the primitive huts that started it all. He highlights that he saw many dead bodies as well as other people on the verge of death. He witnessed the desperation with which men saw their wives and children die. Even in death, women held firmly to their children. It is unfortunate that the Bulgarian heroes also raped the women. The scene was devastating and Candide had never witnessed such evil. Without a doubt, there were no justifiable reasons for the war. The two kings needed to enjoy the glory of winning a war without any noble causes. Unfortunately, the war led to the death of over 30,000 innocent people. Evidently, the society of the Bulgars needed redemption, so that they can restore peace. The society needed reforms if it were to maintain peace and avoid war (9).
